Spousal Visa — South Africa
The Spousal Visa allows foreign spouses of South African citizens or permanent residents to live in South Africa. It is issued under Section 11(6) of the Immigration Act.
Who Is Eligible?
You must be legally married to (or in a recognised life partnership with) a South African citizen or permanent resident. Same-sex marriages recognised under South African law qualify.
Documents Needed
- Completed DHA-1738 application form
- Valid passport with sufficient validity
- Unabridged marriage certificate (apostilled or authenticated if issued abroad)
- Certified copy of spouse's South African ID or PR permit
- Proof of genuine relationship (photos, correspondence, joint accounts, affidavits)
- Proof of accommodation in South Africa
- Medical (DHA-1740) and radiological (DHA-1741) reports
- Police clearance certificates
The Interview
DHA may require a spousal interview to verify the genuineness of the relationship. Both partners may be interviewed separately. Be prepared to answer questions about your relationship history, living arrangements, and future plans.
Processing Times
Approximately 8-12 weeks from submission. Interviews may add additional time.
Work Rights
Spousal visa holders are generally permitted to work in South Africa without a separate work visa.
Pathway to Permanent Residence
After holding a spousal visa for at least 5 years in a genuine relationship, you may apply for permanent residence under Section 26 of the Immigration Act.

- Marriage certificate issues — foreign certificates must be apostilled and may need to be registered with DHA
